Terms of Use

Article 1 — Purpose

These Terms of Use (hereinafter the "ToU") define the conditions of access to and use of the Backgammon Circle platform (hereinafter "the Platform"), available at backgammoncircle.com.

The Platform is an online backgammon service offering games against the computer, online games between players, profile customization features, game history, and, where applicable, puzzles, educational content, analysis tools, competitions and community features.

Any use of the Platform implies full and unreserved acceptance of these ToU. Browsing the Platform and/or creating an account constitutes the user's express and unreserved acceptance of these ToU.

These ToU govern the use of the Platform and the free services offered on it. No paid service is offered to date.

Article 2 — Platform Publisher

Note: This information will be completed upon the company's registration (final legal form, share capital, SIRET number, trade register).

When the user contacts the publisher via the contact address provided herein, the publisher also acts as the point of contact for any question relating to the operation of the Platform or the reporting of illegal content.

Article 3 — Registration and User Account

3.1 — Registration Requirements

Registration on the Platform is free and open to any natural person of legal age with the legal capacity to accept these ToU.

Registration on the Platform is therefore strictly prohibited for minors. The user declares and warrants being at least eighteen (18) years old on the day of account creation and throughout their use of the Platform.

To create an account, the user must provide a valid email address and choose a username. The user may also optionally provide their country of residence, a biography and an avatar.

The user undertakes to provide accurate, complete and up-to-date information, and to update it without delay in the event of any change.

The publisher reserves the right to request any supporting document to verify that the user meets the applicable age requirements and, in the event of legitimate doubt or failure to produce satisfactory proof, to suspend or delete the account concerned under the conditions provided for in these ToU.

3.2 — User Responsibility

The user is solely responsible for the confidentiality of their login credentials (email and password). Any activity carried out from their account is deemed to have been performed by them.

In case of suspected unauthorized use of their account, the user must immediately inform the publisher at contact@backgammoncircle.com.

3.3 — One Account per Person

Each person may hold only one account on the Platform. Creating multiple accounts is prohibited and may result in the suspension or deletion of all accounts concerned, after reasonable verification by the publisher and, except in cases of urgency or manifest fraud, prior notification of the user concerned.

The publisher also reserves the right to refuse a registration, temporarily suspend access to an account or delete it in the event of non-compliance with these ToU, fraud, attempted fraud, identity theft, creation of multiple accounts or risk to the security of the Platform.

Article 4 — Service Description

4.1 — Current Features

The Platform currently offers the following features:

  • Real-time online backgammon games between players, with Elo ranking;
  • Correspondence games (turn-based, with play deadlines);
  • Games against the computer (several difficulty profiles) and local two-player games;
  • Daily puzzles, training arena and mistake review;
  • Interactive lessons and educational content;
  • Game analysis and performance indicators;
  • Player competitions, monthly leagues, clubs and inter-club events;
  • Private messaging, friends, challenges and public profiles;
  • Professional backgammon news and tournament calendar;
  • Profile customization (username, avatar, country, biography) and board themes;
  • Scoring system with doubling cube, gammon and backgammon, and game clocks.

4.2 — Upcoming Features

The Platform is under active development. Additional features will be gradually deployed, including an in-depth analysis engine and a mobile application distributed on the app stores.

The public roadmap, where accessible on the Platform, is purely informative and does not constitute any contractual commitment as to availability, timing, service level or continued availability of a feature.

The publisher reserves the right to modify, suspend or remove all or part of the Platform's features at any time, without notice or compensation, in particular for reasons of maintenance, security, technical development, legal or regulatory compliance, or service improvement.

4.3 — Availability

The publisher endeavors to ensure the Platform is available 24 hours a day, 7 days a week, but cannot guarantee permanent accessibility. The Platform may be temporarily unavailable for maintenance, updates, or force majeure events. The publisher shall not be held liable for service interruptions.

The publisher's obligation in this respect is an obligation of means. The user acknowledges that it is their responsibility to have the equipment, software and telecommunications connections necessary to access and use the Platform, and to bear the related costs.

Article 5 — Rules of Conduct

5.1 — General Behavior

The user agrees to use the Platform in compliance with applicable laws, these ToU and the rules of common courtesy. In particular, it is prohibited to:

  • Use an offensive, discriminatory, vulgar username or one that infringes third-party rights;
  • Harass, insult, threaten or intimidate other users;
  • Distribute illegal, hateful, violent, pornographic or discriminatory content;
  • Impersonate a third party;
  • Collect other users' personal data;
  • Use the Platform for unauthorized commercial purposes or spam.

The user also agrees to comply, where applicable, with any community charter, moderation charter or additional rule brought to their attention on the Platform. In case of contradiction, these ToU prevail.

The following content or behavior is also prohibited: off-topic; non-constructive; constituting disguised advertising; containing unsolicited links, addresses, phone numbers or email addresses; disclosing third parties' personal data; damaging the honor, reputation, privacy or rights of a third party; revealing confidential information or private exchanges; produced in conditions manifestly incompatible with normal use of the Platform; or, more generally, contrary to public order, morality or the purpose of the Platform.

It is also prohibited to interfere with the proper functioning of the Platform, in particular by attempting to fraudulently access the systems, introducing malicious code, misusing the features offered, or carrying out any substantial or repeated extraction of the data and content accessible via the Platform.

5.2 — Fair Play and Game Integrity

The user agrees to play fairly. The following are prohibited:

  • Using assistance software, bots or any automated program during online games;
  • Intentionally manipulating one's ranking (sandbagging, boosting, collusion between accounts);
  • Exploiting bugs or technical flaws to gain an unfair advantage;
  • Any form of cheating or manipulation of results.

The publisher reserves the right to implement any reasonable mechanism for detecting fraudulent behavior or behavior contrary to the integrity of the game, in compliance with applicable regulations, in particular regarding personal data protection.

Article 6 — Moderation and Sanctions

The publisher reserves the right to moderate content and behavior on the Platform. In case of violation of these ToU, the publisher may take the following measures, in proportion to the severity of the breach:

  • Warning: notification reminding the user of the Platform's rules.
  • Temporary suspension: restricted access to the account or to certain features for a set period (24 hours, 7 days, 30 days depending on severity).
  • Permanent ban: account deletion and prohibition to create a new account. This measure is reserved for serious or repeated violations.

Any user may also report to the publisher, via the contact form or the contact address indicated on the Platform, any content or behavior they consider contrary to these ToU, a community charter or applicable regulations. Reports are reviewed within a reasonable time.

The publisher reserves the right, after review, to remove content, make it inaccessible, request additional supporting documents, suspend certain features of the account concerned or impose any sanction provided for in these ToU.

Except where the law, the security of the Platform or the seriousness of the facts justify an immediate measure, the publisher may, as the case may be, inform the user concerned in advance of the measure envisaged and the main reasons for it.

The publisher also reserves the right to remove, make inaccessible or delete without delay any manifestly illegal content or any content contrary to these ToU, and to respond to any request from a competent administrative or judicial authority.

The user concerned may contest a sanction by contacting the publisher at contact@backgammoncircle.com. The publisher undertakes to review each contest within a reasonable time.

Article 7 — Intellectual Property

7.1 — Publisher's Rights

The Platform, its source code, design, graphics, texts, logos, visual identity and all of its content are protected by copyright, trademark law and applicable intellectual property laws.

The "Backgammon Circle" trademark is registered with the French National Institute of Industrial Property (INPI).

Any reproduction, representation, modification, distribution or exploitation of all or part of the Platform or its content, by any means whatsoever, without the publisher's prior written authorization, is strictly prohibited and constitutes infringement punishable under the French Intellectual Property Code.

The user also undertakes not to collect, extract, reproduce or exploit in an automated manner, by any means and in particular using robots, scripts, crawlers, software agents or any other automated device, all or part of the content or data of the Platform, without the publisher's prior written authorization, in particular for commercial purposes or for the training, testing or improvement of artificial intelligence systems.

7.2 — User Content

The user retains intellectual property over any content they publish on the Platform (username, avatar, biography, messages, posts). By publishing content on the Platform, the user grants the publisher a non-exclusive, free, worldwide license, for the duration of their registration, to display, reproduce and distribute this content as part of the operation of the Platform.

This license is strictly limited to the needs of hosting, storage, reproduction, representation, technical adaptation, possible translation and distribution of the content on the Platform and on the digital environments operated by the publisher for the promotion or operation of the service, in compliance with the user's moral rights.

The user is solely responsible for the content, messages, usernames, biographies, comments, contributions, reviews or information they publish or distribute via the Platform. They undertake to ensure that these are lawful, fair, relevant to the purpose of the Platform and do not infringe the rights or legitimate interests of third parties.

The user warrants that they hold all rights and authorizations necessary for the content they upload and that such content does not infringe third-party rights, public order, or applicable laws and regulations.

Backgammon games played on the Platform and associated game data (moves, results, statistics) may be used by the publisher in anonymized form for service improvement, research, statistical analysis or editorial content purposes.

Article 8 — Limitation of Liability

The Platform is provided "as is". The publisher strives to ensure the quality and reliability of the service but cannot guarantee the total absence of bugs, errors or interruptions.

The publisher shall not be held liable for:

  • Direct or indirect damages resulting from the use or inability to use the Platform
  • Loss of game data in the event of a technical incident
  • The behavior of other users on the Platform
  • Content published by users
  • Service interruptions related to maintenance operations or force majeure events

In any event, nothing in these ToU is intended to exclude or limit any liability that cannot be excluded or limited under mandatory provisions of French law.

The user acknowledges that the Platform is an entertainment and backgammon training service. Unless expressly stated otherwise, it is not intended for the organization of gambling with financial stakes or the award of monetary winnings.

Article 9 — Personal Data

The processing of users' personal data is described in the Privacy Policy, available at backgammoncircle.com/privacy. This policy forms an integral part of these ToU.

The publisher invites the user to also consult the cookie policy and the legal notice available on the Platform.

Where data processing is carried out in connection with account creation, game management, moderation, Platform security or fraud prevention, it is performed under the conditions specified in the Privacy Policy.

Article 10 — Account Deletion

10.1 — At the User's Initiative

The user may delete their account at any time from their profile settings, without justification or penalty. Deletion results in the permanent erasure of all associated personal data within 30 days, in accordance with the Privacy Policy.

Game history may be retained in anonymized form for statistical purposes.

Subject to legal retention obligations, evidentiary needs, claims management or the prevention of fraud and abuse, certain data may be kept in intermediate form or archived for the period strictly necessary for the purposes concerned, in accordance with the Privacy Policy.

10.2 — At the Publisher's Initiative

The publisher reserves the right to delete an account in the event of a serious or repeated violation of these ToU, in accordance with Article 6. The user will be informed by email.

The publisher may also delete accounts inactive for more than 24 months, after prior notification by email 30 days before the effective deletion.

If it is impossible to reach the user at a valid email address, the publisher may use any other reasonable means of notification available on the Platform.

Article 11 — Paid Offers (Future)

The Platform may in the future offer paid subscriptions giving access to advanced features. These offers will be subject to specific Terms of Sale which will be presented to the user before any subscription.

Access to multiplayer online play will remain free. However, this statement has no contractual value for the future and may evolve subject to adequate prior notification of the users concerned.

Article 12 — External Links

The Platform may contain links to third-party websites. The publisher has no control over these sites and declines all responsibility for their content, their data protection practices or their availability.

The existence of such links shall not be interpreted as an endorsement or validation of said sites, their content or the services they offer.

Article 13 — Amendments to the ToU

The publisher reserves the right to amend these ToU at any time. Users with an account will be informed of any substantial change by email at least 15 days before the new terms come into force.

Continued use of the Platform after the new ToU come into force constitutes acceptance thereof. If the user refuses the new terms, they may delete their account before they come into force.

The applicable version is the one in force on the day the Platform is used or, for users with an account, the one brought to their attention in accordance with this article.

Article 14 — Governing Law and Jurisdiction

These ToU are governed by French law.

In the event of a dispute relating to the interpretation or performance of these ToU, the parties will endeavor to find an amicable solution. Failing an amicable agreement, the dispute will be brought before the competent French courts, subject to applicable mandatory rules and, where applicable, the consumer's right to bring proceedings in particular before the court of the place where they resided at the time the contract was concluded or the harmful event occurred.

In accordance with Article L. 612-1 of the French Consumer Code, in the event of an unresolved dispute, the consumer user may have free recourse to a consumer mediator. The contact details of the competent consumer mediator will be communicated to the user and/or published on the Platform as soon as the publisher falls within the scope of this obligation with regard to the services actually offered.
